1. Agreement to these terms

These Terms of Use govern your access to and use of the Braeswim website and waitlist. By using the site, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the site or submit the waitlist form.

You must be at least 13 to submit personal information through the site. If you are not old enough to agree to these Terms where you live, a parent or legal guardian must approve your use.

2. Braeswim is in development

The current site shares a developing concept and design intent. Product construction, fit, sizing, color, materials, pricing, timing, availability, and other details may change through sampling and testing.

Statements about planned features or size goals describe current intentions, not finished-product guarantees. Joining the waitlist is not a preorder, reservation, deposit, purchase, or guarantee that a product will launch or be available in a particular size or on a particular date.

These Terms do not govern future purchases. Before checkout opens, Braeswim will provide the sales, shipping, return, exchange, and other terms that apply to orders.

3. Waitlist and email communications

When you submit your email address, you ask Braeswim to send waitlist communications, which may include sample updates, product development news, launch information, first-access notices, and promotional offers.

You can unsubscribe at any time using the link in any marketing email. Unsubscribing may prevent you from receiving future waitlist benefits or launch notices. You are responsible for providing an email address you are authorized to use and for keeping access to that inbox.

4. First access and promotions

The current waitlist offer includes first-access communications and a 10% launch offer. The offer's eligibility, timing, expiration, product exclusions, redemption process, and any other material conditions will be disclosed with the offer before purchase.

First access does not guarantee inventory, a specific shopping window, or the ability to purchase every size or color. Promotional offers have no cash value and are subject to applicable law.

5. Acceptable use

You may use the site only for lawful, personal, and noncommercial purposes. You may not:

• interfere with the site's operation, security, or availability;
• attempt to gain unauthorized access to systems or information;
• submit another person's information without authorization;
• use automated tools to scrape, copy, or overload the site;
• introduce malicious code or use the site for fraud or unlawful activity; or
• misrepresent an affiliation with Braeswim.

We may restrict access or remove waitlist entries when reasonably necessary to protect the site, Braeswim, our service providers, or other users.

6. Ownership and permitted use

The Braeswim name, site design, original copy, graphics, and other brand materials are owned by Braeswim or used with permission and are protected by applicable intellectual-property laws. Third-party photography and other credited materials remain the property of their respective owners.

We give you a limited, revocable, nonexclusive right to access the site for personal use. No other license is granted. You may not reproduce, distribute, modify, sell, or exploit site content without prior written permission or a right provided by law.

7. Third-party services and links

The site uses or links to third-party services, including Kit, Instagram, TikTok, and Pexels. Those services are operated independently and may have their own terms and privacy practices. Braeswim is not responsible for third-party content, availability, security, or practices.

8. Disclaimers

To the fullest extent permitted by law, the site and its content are provided "as is" and "as available." Braeswim disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement as they relate to the current informational site.

We do not promise that the site will always be available, secure, error-free, or complete. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

9. Limits on liability

To the fullest extent permitted by law, Braeswim and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of, or inability to use, the site.

Where liability cannot be excluded, it will be limited to the minimum amount permitted by applicable law. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Changes, law, and general terms

We may update the site and these Terms as Braeswim develops. The revised Terms will be posted here with a new effective date. Continued use after the updated Terms become effective means you accept them.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where the law where you live requires otherwise. These Terms do not limit non-waivable consumer protections.

If any part of these Terms is found unenforceable, the remaining parts will continue in effect. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement governing the current pre-launch site.
